1. About the Services

Scent Atlas

Scent Atlas allows users to discover, create, document, organize, and share information about scents, scent experiences, materials, environments, and locations associated with scent.

Scent Atlas content is provided for informational, cultural, creative, and entertainment purposes. It is not scientific, medical, environmental, safety, or professional advice.

2. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian.

By using the Services, you represent that you meet these requirements and are legally able to agree to these Terms.

3. Accounts

Some features may require an account. You agree to:

• Provide accurate and current information.
• Keep your login credentials confidential.
• Promptly update information that becomes inaccurate.
• Accept responsibility for activity conducted through your account.
• Notify us if you believe your account has been accessed without authorization.

You may not impersonate another person, create an account using information you are not authorized to use, or transfer your account without our permission.

4. User Entries and Content

The Services may allow you to submit or create names, descriptions, counters, clicks, comments, photographs, scent observations, location information, tags, ratings, links, or other material. We refer to this material collectively as “User Content.”

You retain ownership of your User Content, subject to the rights you grant us below.

You represent and warrant that:

1. You own your User Content or have permission to submit it.
2. Your User Content does not violate another person’s intellectual-property, privacy, publicity, contractual, or other rights.
3. Your User Content is accurate to the best of your knowledge and is not deliberately misleading.
4. Your User Content complies with these Terms and applicable law.

5. License to User Content

By submitting User Content, you grant the Company a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, format, translate, display, distribute, and otherwise use that User Content as reasonably necessary to operate, improve, promote, and provide the Services.

This license allows us, for example, to display a public entry on a map, resize an uploaded image, display a ScentAtlas entry to other users, or create technical backup copies.

The license ends when the User Content is deleted from our active systems, except:

• To the extent the content has been shared with or copied by others.
• For limited backup, security, fraud-prevention, legal, or compliance purposes.
• For aggregated or de-identified information that no longer reasonably identifies you.

6. Public Content and Location Information

Some User Content may be visible to the public. Public content may be viewed, copied, photographed, indexed, shared, or used by other people outside the Services.

Do not submit private, confidential, or sensitive information that you do not want made public.

When submitting a location to ScentAtlas feature, you must not:

• Publish another person’s private home address without authorization.
• Identify a person’s real-time or routine location in a manner that could create a safety risk.
• Trespass or enter restricted property.
• Encourage others to access an unsafe, unlawful, environmentally sensitive, or prohibited location.
• Misrepresent whether a location is public, accessible, or safe.
• Use the Services to track, stalk, harass, or monitor another person.

A location appearing in the Services does not mean that the location is publicly accessible, safe, lawful to enter, currently open, or endorsed by the Company. You are responsible for following posted rules, obtaining permission, evaluating conditions, and using appropriate judgment.

7. Entry and Account Deletion

Deletion by You

You may delete your entries or account at any time for any reason through the available account controls.

Deleting an account may permanently delete or anonymize associated User Content, clicks, preferences, and account information, subject to limited retention for legal, security, fraud-prevention, backup, or operational purposes.

Deletion may not remove:

• Content copied, reshared, or independently submitted by another user.
• Aggregated or de-identified information.
• Information we are legally required or permitted to retain.
• Data remaining temporarily in routine backups.

Deletion or Suspension by the Company

To the fullest extent permitted by law, we may remove, edit, restrict, hide, suspend, disable, or permanently delete any entry, User Content, username, or account at any time, for any reason or no stated reason, with or without prior notice.

Reasons may include suspected violations of these Terms, inactivity, technical or security concerns, legal risk, misleading information, intellectual-property complaints, safety concerns, abuse, changes to the Services, or conduct we believe could harm the Company, the Services, users, or others.

We are not obligated to preserve any account, entry, click history, location record, or other User Content. You should maintain your own copies of anything you wish to preserve.

8. Prohibited Conduct

You may not use the Services to:

• Violate any law or regulation.
• Infringe intellectual-property, privacy, publicity, or other rights.
• Harass, threaten, stalk, exploit, or harm another person.
• Publish unlawful, fraudulent, defamatory, obscene, hateful, or deliberately misleading material.
• Manipulate click counts, rankings, engagement, or other metrics through bots, scripts, deceptive practices, coordinated artificial activity, or unauthorized automation.
• Scrape, crawl, harvest, or extract data except as expressly permitted by us.
• Introduce malware or attempt to interfere with the security or operation of the Services.
• Access accounts, systems, or data without authorization.
• Reverse engineer or attempt to derive source code except where applicable law expressly permits it.
• Use the Services to build or train a competing product, dataset, map, directory, or artificial-intelligence system without our written permission.
• Submit excessive, duplicative, irrelevant, or spam content.
• Use another person’s identity or location without authorization.
• Circumvent access controls, usage limits, or content restrictions.

9. Community Moderation

We may, but are not required to, review or moderate User Content. Our decision not to remove content does not constitute approval or endorsement.

We may investigate reports and take any action we consider appropriate, but we do not guarantee a particular response or outcome.

10. Intellectual Property

Except for User Content, the Services and all related software, design, branding, text, graphics, interfaces, databases, compilations, and other materials are owned by or licensed to the Company and are protected by applicable intellectual-property laws.

“ScentAtlas,”associated logos, and other Company marks may not be used without our prior written permission.

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for their intended personal or internal business purposes.

11. Feedback

If you provide ideas, suggestions, or other feedback concerning the Services, you grant us the unrestricted right to use that feedback without compensation, attribution, or obligation to you.

12. Third-Party Services and Links

The Services may use or link to third-party maps, authentication providers, hosting providers, analytics tools, websites, or services.

We do not control and are not responsible for third-party services. Your use of them may be governed by separate terms and privacy policies.

13. Changes to the Services

We may add, modify, suspend, restrict, or discontinue any portion of the Services at any time. Features, availability, storage, eligibility, and usage limits may change without notice.

We are not liable for the modification, suspension, loss, or discontinuation of any feature, account, entry, click history, location, or User Content.

14. No Professional Advice

Information available through the Services is general information only.

Company does not provide financial, fundraising, charitable, medical, legal, psychological, or professional advice.

Company does not provide medical, toxicological, environmental, accessibility, property-access, travel, or safety advice. Scent descriptions and perceptions are subjective and may vary considerably between people.

You should not rely on the Services when making decisions involving health, safety, legal rights, financial commitments, property access, or other significant matters.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

THE COMPANY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.

WE DO NOT WARRANT THAT:

• THE SERVICES WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE.
• USER CONTENT OR LOCATION INFORMATION WILL BE ACCURATE OR COMPLETE.
• CLICK COUNTS OR OTHER METRICS WILL BE FREE FROM ERROR OR MANIPULATION.
• CONTENT WILL BE PRESERVED.
• A LOCATION WILL BE SAFE, ACCESSIBLE, OPEN, OR LAWFUL TO VISIT.
• USE OF THE SERVICES WILL PRODUCE ANY PARTICULAR RESULT.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

1. The amount you paid us during the 12 months preceding the event giving rise to the claim; or
2. US $50.

These limitations apply regardless of the legal theory and even if we were advised that damages were possible.

Nothing in these Terms excludes liability that cannot legally be excluded.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, directors, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

• Your use of the Services.
• Your User Content.
• Your violation of these Terms.
• Your violation of applicable law.
• Your infringement or violation of another person’s rights.
• Your visit to or interaction with a location identified through the Services.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, you and the Company agree that disputes arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Colorado, and each party consents to their jurisdiction.

Nothing in this section prevents either party from seeking appropriate relief in small-claims court or requesting emergency injunctive relief.

19. Changes to These Terms

We may update these Terms periodically. The revised Terms will be posted with a new “Last Updated” date.

When required by law, we will provide additional notice or request consent. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

20. General Provisions

These Terms constitute the entire agreement between you and the Company regarding the Services unless another written agreement applies.

If a provision is found unenforceable, the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our permission. We may assign these Terms as part of a merger, financing, reorganization, sale of assets, or similar transaction.

Headings are for convenience only.

1. Information We Collect

The information we collect depends on which Service and features you use.

Account Information

When you create or maintain an account, we may collect:

• Your name or display name.
• Username.
• Email address.
• Profile image.
• Account preferences.
• Login and authentication information.
• Records relating to account creation, verification, and access.

If you sign in through a third-party authentication provider, such as Google or Apple, we may receive information that you authorize that provider to share with us.

User Entries and Content

We collect information you choose to create, upload, submit, or share through the Services.

Scent Atlas may use location information to:

• Display scent entries on a map.
• Associate scent observations with places.
• Show nearby entries.
• Organize and search location-based content.
• Allow users to document scents associated with specific places.

Some entries and User Content may be public. Public information may be viewed, copied, indexed, photographed, shared, or otherwise used by people outside the Services.

Do not submit information that you do not want made public.

Location Information

With your permission, the Services may collect location information from your device.

Depending on your settings and how you use the Services, location information may include:

• Approximate location.
• Precise geographic coordinates.
• A location you search for.
• A location you manually enter.
• A location associated with an entry.
• A city, region, or nearby place derived from location data.
• The date and time associated with a location submission.

ScentAtlas may use location information when you create or interact with a location-based entry or feature.

We will request permission before accessing device location where required. You can deny or withdraw location permission through your browser or device settings. Some features may not function properly without location access.

Unless separately disclosed and affirmatively enabled, we do not intend to continuously track your precise location when you are not actively using a location-dependent feature.

Device and Technical Information

We and our service providers may automatically collect:

• Device type and model.
• Operating system and version.
• Browser type and language.
• Application version.
• Internet Protocol address.
• Device, browser, or application identifiers.
• Screen size and display settings.
• Mobile carrier or network information.
• Referring and exit pages.
• Crash reports.
• Diagnostic and performance information.
• Cookie and local-storage information.

Usage Information

We may collect information about how you interact with the Services, including:

• Pages and screens viewed.
• Features used.
• Searches performed.
• Entries created, viewed, edited, or deleted.
• Click activity.
• Links selected.
• Session dates, times, and duration.
• General engagement information.
• Errors, logs, and system events.

Communications

When you contact us, report content, request support, participate in research, or respond to a survey, we may collect your contact information and the contents of your communication.

2. How We Use Information

We may use the information we collect to:

• Create, authenticate, and maintain accounts.
• Operate ScentAtlas
• Save and display entries, clicks, observations, and locations.
• Provide maps and location-related features.
• Show nearby or location-relevant content.
• Personalize the Services.
• Respond to support requests.
• Communicate about accounts, security, features, and policy updates.
• Moderate entries and User Content.
• Enforce our Terms of Use.
• Investigate reports and complaints.
• Detect fraud, spam, manipulation, abuse, and security threats.
• Troubleshoot technical problems.
• Measure and improve performance.
• Understand how people use the Services.
• Develop and test new features.
• Protect the Company, users, and others.
• Comply with legal obligations.
• Establish, exercise, or defend legal claims.

We may also create and use aggregated or de-identified information that does not reasonably identify an individual.

3. How We Disclose Information

We may disclose information in the following circumstances.

Service Providers

We may disclose information to vendors and contractors that help us provide:

• Cloud hosting.
• Databases and storage.
• Maps and location services.
• Account authentication.
• Analytics.
• Email and communications.
• Customer support.
• Error monitoring.
• Security and fraud prevention.

These providers may process information only as permitted by their agreements with us and applicable law.

Public Entries and Content

Entries and User Content that you make public may be visible to anyone.

Public entries may include your display name, entry information, descriptions, photographs, tags, click information, and associated locations.

Public content may also appear in search-engine results or be shared outside the Services.

At Your Direction

We may disclose information when you request or authorize us to do so, or when you use a feature that clearly involves sharing information with another person or service.

Legal and Safety Reasons

We may disclose information when we reasonably believe it is necessary to:

• Comply with applicable law.
• Respond to legal process or a government request.
• Protect the rights, property, or safety of the Company, users, or others.
• Investigate fraud, abuse, threats, harassment, or security incidents.
• Enforce our Terms of Use and other policies.
• Establish, exercise, or defend legal claims.

Business Transactions

Information may be disclosed or transferred as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

Professional Advisers

We may disclose information to attorneys, accountants, insurers, auditors, and other professional advisers where reasonably necessary.

4. Sale of Personal Information and Advertising

We do not sell personal information for money.

We do not use precise location information for cross-context behavioral advertising or sell precise location information to third parties.

No behavioral advertising version:

We do not share personal information for cross-context behavioral advertising or process personal information for targeted advertising as those terms are defined under applicable privacy laws.

5. Cookies and Similar Technologies

We and our service providers may use cookies, local storage, pixels, software development kits, and similar technologies to:

• Keep users signed in.
• Remember preferences.
• Maintain security.
• Prevent fraud.
• Measure performance.
• Understand Service usage.
• Diagnose technical problems.
• Support analytics.
• Support advertising, if applicable.

You may be able to control these technologies through your browser, device, consent interface, or privacy settings.

Disabling necessary technologies may prevent some features from working.

6. Location Privacy and Choices

You control whether the Services may access your device location through your browser or device settings.

Where supported, you may:

• Enter a location manually instead of sharing device location.
• Remove a location from an entry.
• Change the location associated with an entry.
• Delete a location-based entry.
• Disable future device-location access.
• Delete your account.

Removing device-location permission does not automatically delete location information you previously submitted.

Previously submitted location information may be removed by editing or deleting the relevant entry

Do not submit:

• Your private home address.
• Another person’s private address.
• Another person’s real-time location.
• Locations that could expose a person to harassment or danger.
• Restricted, confidential, or sensitive locations.
• Location information you do not have permission to share.

7. Entry Deletion

You may delete your entries at any time for any reason through the available controls.

Deleting an entry may remove it from public view and our active systems. However, limited copies may remain temporarily in backups, logs, security records, or other systems used for legal and operational purposes.

Deletion may not remove:

• Content copied or independently submitted by another user.
• Screenshots or copies created by other people.
• Information shared outside the Services.
• Aggregated or de-identified information.
• Information we are legally required or permitted to retain.

The Company may also remove, hide, restrict, edit, or permanently delete any entry or User Content at any time, for any reason or no stated reason, with or without prior notice, to the extent permitted by law.

Reasons may include suspected policy violations, inaccurate or misleading content, safety concerns, privacy concerns, intellectual-property complaints, inactivity, technical requirements, legal risk, or changes to the Services.

8. Account Deletion

You may delete your account at any time for any reason through the available account controls.

When an account is deleted, we may delete or de-identify:

• Account information.
• Profile information.
• Entries and User Content.
• Click history.
• Saved locations.
• Preferences.
• Other information associated with the account.

Some public or collaborative content may be anonymized rather than deleted when necessary to preserve the integrity of shared features, provided it is no longer reasonably associated with your account.

Account deletion may not immediately remove information:

• From routine backup systems.
• That we must retain to comply with law.
• Needed for security or fraud prevention.
• Needed to resolve disputes or enforce agreements.
• Included in aggregated or de-identified data.
• Independently copied or submitted by another person.
• Needed to document that a deletion request was completed.

The Company may suspend, restrict, deactivate, or permanently delete any account at any time, for any reason or no stated reason, with or without prior notice, to the extent permitted by law.

You should maintain your own copies of any entries or information you want to preserve.

9. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods may depend on:

• Whether an account remains active.
• The type and sensitivity of the information.
• Why the information was collected.
• Whether an entry remains public.
• Security and fraud-prevention needs.
• Legal, accounting, or regulatory requirements.
• The need to resolve disputes or enforce agreements.

When information is no longer reasonably necessary, we may delete, aggregate, or de-identify it.

10. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

• Confirm whether we process your personal information.
• Access personal information we maintain about you.
• Correct inaccurate personal information.
• Request deletion of personal information.
• Obtain a portable copy of certain information.
• Withdraw consent where processing is based on consent.
• Object to or restrict certain processing.
• Opt out of certain sales, sharing, targeted advertising, or profiling.
• Appeal a decision concerning a privacy request.
• Submit a complaint to an appropriate privacy regulator.

We may need to verify your identity before completing a request. We may also ask an authorized agent to provide evidence that the agent is permitted to act for you.

We will not unlawfully discriminate against you for exercising a privacy right.

11. California Privacy Notice

This section applies only to the extent California privacy law applies to the Company.

During the preceding 12 months, we may have collected the following categories of personal information:

• Identifiers, such as names, usernames, email addresses, Internet Protocol addresses, and account identifiers.
• Internet or electronic activity information, such as usage and interaction information.
• Geolocation information, including approximate or precise location when enabled.
• User-generated content.
• Device, diagnostic, and technical information.
• Communications with the Company.
• Inferences relating to preferences or interests based on Service activity.

We obtain this information from:

• Users.
• User devices and browsers.
• Authentication providers.
• Service providers.
• Other users who submit content.

We use and disclose these categories for the purposes described in this Privacy Policy.

California residents may have the right to request access, correction, or deletion and to opt out of certain sales, sharing, or targeted advertising, subject to applicable exceptions.

12. Sensitive Personal Information

Precise geolocation may be considered sensitive personal information under certain privacy laws.

We use precise location information only to:

• Provide a location feature requested by the user.
• Display or save an entry at a selected location.
• Show nearby or relevant content.
• Maintain security.
• Prevent fraud or abuse.
• Comply with law.
• Carry out other purposes permitted by applicable law.

We do not use precise location information to infer sensitive personal characteristics.

We do not sell precise location information.

Where required by law, we will provide additional controls relating to the use or disclosure of sensitive personal information.

13. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information.

These measures may include access controls, encryption, authentication safeguards, system monitoring, and restrictions on service-provider access.

However, no storage or transmission method is completely secure. We cannot guarantee that unauthorized access, loss, misuse, alteration, or disclosure will never occur.

You are responsible for:

• Using a strong and unique password.
• Keeping login credentials confidential.
• Maintaining control of your device.
• Promptly notifying us of suspected unauthorized account activity.

14. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Users between 13 and the age of legal majority where they live should use the Services only with permission from a parent or legal guardian.

15. Third-Party Services

The Services may use or connect with third-party providers

These providers may collect or process information under their own privacy policies.

We are not responsible for the privacy practices of third-party websites, applications, or services that we do not control.

16. International Users

The Company is based in The United States.

If you access the Services from another country, your information may be transferred to, stored in, or processed in countries with privacy laws that differ from those in your location.

Where required, we will use an appropriate legal mechanism for international transfers of personal information.

17. Opt-Out Preference Signals

Some browsers and devices provide privacy preference signals, such as Global Privacy Control.

Where required by applicable law, we will treat a recognized opt-out preference signal as a request to opt out of applicable sales, sharing, or targeted advertising for the browser or device sending the signal.

Because there is not a universally accepted standard for every privacy signal, our response may depend on the signal, browser, device, and applicable law.

18. Changes to This Privacy Policy

We may update this Privacy Policy periodically.

When we make changes, we will post the revised policy and update the “Last Updated” date.

If changes materially affect how we use personal information or affect your privacy rights, we will provide additional notice or request consent where required by law.
